Examinations under oath can be extremely treacherous proceedings! This is a proceeding where an insurance company may have you sworn under oath and then examined by one of its attorneys. These examinations can sometimes last for a number of days. If your insurance company says that it wishes to conduct an examination under oath, it may suspect you of fraud. Some policies give the insurance company the right to examine you under oath. They do not need to tell you why or to provide you any information about it. The principal purpose of an examination under oath may not be to resolve your claim or simply gather information, but instead, to induce or trick you into making a mistake in your testimony. Some insurance companies will deny your claim simply because you made a mistake in your testimony in an examination under oath. It is easy to make a mistake when the insurance company has not given you the documents they have before you testify.
It is always useful to retain an attorney familiar with examinations under oath before you agree to attend one.
